1.1 Agreement to Terms
These Terms & Conditions ("Terms") are a binding agreement between you ("Client," "you," or "your") and OptiMythik, LLC, a Utah limited liability company ("OptiMythik," "we," "us," or "our"), governing your access to and use of optimythik.com and any related services, assessments, coaching, bookings, digital resources, subscriptions, or custom-quoted engagements (collectively, the "Services").
By creating an account, booking a service, purchasing a digital resource, subscribing to a plan, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
OptiMythik serves individual clients as well as businesses, non-profits, and other organizations. If you use the Services on behalf of a company, non-profit, or other organization, "you" and "Client" refer to that organization as well as to you individually, and by accepting these Terms you represent that you have the authority to bind that organization to them. Where a specific offer or engagement is instead governed by a separately signed Statement of Work or proposal, that document's terms control over any conflicting provision here, and these Terms continue to apply to everything the SOW does not address.
1.2 Eligibility
The Services are intended for individuals aged 18 or older, or 16 or older with the informed consent of a parent or legal guardian where applicable to a specific assessment or program. A representative accepting these Terms on behalf of an organization must themselves be at least 18 years old. By using the Services, you represent that you meet this requirement.
1.3 Description of Services
OptiMythik provides diagnostic assessments, planning sessions, one-time digital resources, software/tool subscriptions, recurring advisory retainers, and custom transformation, integration, and bundled engagements, across six client segments: Individuals, Aspiring Business Owners, Solopreneurs, Small & Medium Businesses, Mid-to-Large Businesses, and Non-Profit Organizations. Specific offer descriptions, scope, and pricing are as listed on the Site at the time of purchase or booking, or as set out in a separately signed Statement of Work("SOW") or proposal for custom engagements.
IMPORTANT OptiMythik's assessments and coaching services are personal and organizational development tools, not clinical, medical, or diagnostic instruments, and do not guarantee any particular outcome. 1.4 Pricing, Promotions, and AI Use in Service Delivery
Every Service has one national list price, shown on the Site at the time of purchase or booking. There are no separate Local, National, or International price tiers.
We may offer promotional coupon codes from time to time (for example, local/regional, early-booking, nonprofit-verification, or referral discounts). Coupons are subject to their own stated eligibility rules, are not combinable beyond any stated stacking limit, have no cash value, and may be modified or discontinued at any time before redemption. Misuse of a coupon (e.g., false nonprofit-status claims) may result in the discount being reversed and the order re-billed at list price.
Some Services may involve the use of artificial intelligence tools (for example, in drafting portions of assessment reports, coaching notes, or content) as part of how OptiMythik prepares deliverables. See our Disclaimers (Section 4.2: AI Use Disclosure) for what this means and how to ask us about it.
1.5 Booking, Purchases, and Payment
Bookings: Diagnostic and planning sessions are scheduled through the Site's booking system. You agree to provide accurate contact information and to attend at the scheduled time or reschedule/cancel per the cancellation policy in Section 1.6 of this document.
Digital resources: One-time digital products are delivered electronically upon payment. Because these are digital goods delivered instantly, all sales are final except as described in Section 1.6 of this document and Section 5 (Return & Refund Policy).
Subscriptions and retainers: Recurring plans renew automatically at the interval and price shown at signup until cancelled by you through your account or by written notice to us. You may cancel at any time; cancellation takes effect at the end of the then-current billing period.
Custom/quote-based engagements (Transformation, Integration, and Bundle services): Pricing and scope are proposed individually based on your submitted request and finalized in a signed SOW or proposal before work begins or payment is collected.
All prices are shown in USD.
1.6 Cancellations, Rescheduling, and Refunds
Bookable sessions may be rescheduled or cancelled up to 24 hours before the scheduled time without charge.
Cancellations made within 24 hours of the scheduled time, and no-shows, are not eligible for a refund.
Digital resources are non-refundable once delivered, except where required by applicable consumer protection law or as described in our Return & Refund Policy (Section 5.2).
Subscriptions may be cancelled at any time; we do not provide partial-period refunds for unused time in a billing cycle, except where required by law.
Custom engagement refund terms are governed by the applicable signed SOW.
Full detail, including no-show handling and the refund request process, is in our standalone Return & Refund Policy (Section 5). The figures in that policy and in this section are kept identical.
1.7 Intellectual Property
All assessment content, frameworks, reports, templates, toolkits, and other materials provided through the Services are the property of OptiMythik, LLC and are licensed to you for your own personal or internal organizational use only. You may not resell, redistribute, publicly republish, scrape, or use OptiMythik's assessment instruments or reports for research, publication, or commercial resale without our prior written consent. See our Acceptable Use Policy (Section 6) for the full list of prohibited uses.
1.8 Confidentiality of Assessment Data
Your individual assessment responses and results are confidential to you (or, for organizational engagements, confidential per the terms agreed with your organization). See our Privacy Policy (Section 2) for how we collect, use, and protect this data. Team- or organization-level reporting is provided only in aggregated, anonymized form and only with the informed, voluntary consent of participants, consistent with our assessment blueprints' compliance requirements.
1.9 Testimonials and Endorsements
If we feature client testimonials, reviews, or endorsements on the Site or in marketing, they reflect genuine client experiences. Where a testimonial comes from someone with a material connection to OptiMythik (e.g., a discount, free service, or payment in exchange for the testimonial), that connection will be disclosed, consistent with FTC endorsement guidelines. Individual results vary — see Disclaimers (Section 4.3: No Guaranteed Outcomes).
1.10 Limitation of Liability
To the maximum extent permitted by law, OptiMythik's total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to OptiMythik for the specific Service giving rise to the claim in the twelve (12) months preceding the claim. OptiMythik is not liable for indirect, incidental, consequential, or punitive damages.
1.11 Disclaimer of Warranties
The Services are provided "as is" and "as available." OptiMythik makes no warranty that the Services will meet your specific goals or produce any particular business, financial, or personal outcome. See Disclaimers (Section 4) for the full disclaimer language.
1.12 Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally will be subject to the exclusive jurisdiction and venue of the state and federal courts located in Cache County, Utah, and each party consents to personal jurisdiction there. These Terms do not include a mandatory arbitration clause or class-action waiver; OptiMythik may add one in a future update, with notice as described in Section 1.13 below.
1.13 Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on the Site with an updated "Last Updated" date. Continued use of the Services after changes take effect constitutes acceptance.
