Privacy Policy

2.1 Scope

This Privacy Policy describes how OptiMythik, LLC ("OptiMythik," "we," "us") collects, uses, discloses, and protects personal information collected through optimythik.com, our booking system, our digital storefront, our subscription platform, our custom quote request form, and related services (collectively, the "Services").


2.2 Information We Collect

  • Information you provide directly: name, email address, phone number, company/organization name, billing/shipping information (processed by our payment processor, not stored by us in raw form), assessment responses, coaching session notes, form submissions, and any other information you choose to share.

  • Information collected automatically: IP address, browser type, device information, pages visited, and similar analytics data, collected via cookies and similar technologies (see Section 3, Cookie Policy).

  • Information from third parties: payment confirmation data from our payment processor; scheduling data from our booking provider.


2.3 How We Use Information

We use personal information to: deliver and administer the Services you request (bookings, purchases, subscriptions, custom engagements); generate assessment results and reports; communicate with you about your account, bookings, and orders; respond to quote requests; send you marketing communications where you have opted in (and you may opt out at any time); improve and secure the Site; and comply with legal obligations.


2.4 Assessment Data Specifically

Individual assessment results are treated as sensitive and are not shared with employers, team leads, or any third party without your explicit, separate written consent, consistent with the confidentiality and non-evaluative-use commitments described in our assessment materials and in the Disclaimers Section 4.1 (Non-Clinical, Non-Diagnostic Disclaimer). Aggregate, anonymized team-level data may be used only where all participants have separately and voluntarily consented.


2.5 How We Share Information

We do not sell your personal information. We share information only with: service providers who help us operate the Services (e.g., our website/booking platform, payment processor, email provider) under confidentiality obligations; professional advisors (legal, accounting) as needed; and law enforcement or regulators where required by law. If OptiMythik is acquired or merges with another company, personal information may be transferred as part of that transaction, subject to this Policy or a successor policy with comparable protections.


2.6 Marketing Communications (Email and Text)

If you opt in to receive marketing communications from us:


  • Email: every marketing email will include a clear, working unsubscribe mechanism (honored within 10 business days), our valid business address, an accurate and non-deceptive subject line, and accurate sender identification, consistent with the federal CAN-SPAM Act.

  • Text/SMS: we will only send marketing text messages if you have given prior express written consent, and we will disclose that consent is not a condition of purchase and that message and data rates may apply, consistent with the federal Telephone Consumer Protection Act (TCPA). Every marketing text includes a simple opt-out (e.g., "Reply STOP to unsubscribe"), honored promptly, and we do not send marketing texts before 8:00 a.m. or after 9:00 p.m. in your local time zone.

  • Transactional messages (booking confirmations, receipts, account notices) are not marketing communications and are sent regardless of marketing opt-in status, as needed to deliver the Services you requested.


2.7 Data Retention

We retain personal information for as long as needed to provide the Services, comply with legal and tax obligations, resolve disputes, and enforce agreements. Individual assessment results specifically are retained for up to three (3) years from your last engagement with OptiMythik, unless you request earlier deletion under Section 2.8 (see below).


2.8 Your Rights, and Where OptiMythik Stands on Utah Privacy Law

Depending on your location, you may have the right to access, correct, delete, or export your personal information, and to opt out of marketing communications or certain data uses. To exercise these rights, contact us at contact@optimythik.com.


A plain statement about the Utah Consumer Privacy Act (UCPA): the UCPA applies only to businesses that (a) conduct business in Utah or target Utah residents, and (b) have $25,000,000 or more in annual revenue, and (c) either process the personal data of 100,000+ Utah consumers annually, or process the data of 25,000+ consumers while deriving more than 50% of revenue from selling personal data. As a small startup LLC, OptiMythik does not meet the UCPA's revenue or data-volume thresholds today, and the UCPA is not currently a binding legal obligation for this business. We are stating that plainly rather than overclaiming a legal requirement that doesn't yet apply. That said,

we have chosen to adopt UCPA-aligned practices anyway — a clear privacy notice, honoring opt-out requests, and giving notice before using any sensitive data in a new way — because it is a low-cost, trust-building choice today and future-proofs the business if it scales past those thresholds. We re-check this threshold annually as revenue grows.


2.9 Children's Privacy

The Services are not directed to children under 16. Where an assessment is offered to participants aged 16–17, we require parental or guardian consent as described in the applicable assessment's terms. We do not knowingly collect personal information from children under 13.


2.10 Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.


2.11 International Users

If you access the Services from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.


2.12 Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted with an updated "Last Updated" date.
